About these terms
These terms govern your use of the TPO Search website at tposearch.co.uk (the “Site”), operated by T Corp Ltd (“we”, “us”, “our”), a company registered in England and Wales.
By using the Site, you agree to these terms. If you do not agree, please do not use the Site.
What we provide
TPO Search is an information service that aggregates publicly available Tree Preservation Order (TPO) data from local planning authorities across the UK. We present this data in a searchable format to help users identify protected trees in their area.
Data accuracy and limitations
This is the most important section of these terms. Please read it carefully.
- The TPO data displayed on this Site is sourced from local planning authorities and other public sources. We do not create, verify, or maintain this data.
- Data may be incomplete, outdated, or inaccurate. Not all planning authorities publish their TPO data openly, and those that do may not update it regularly.
- The absence of a TPO on our Site does not mean that a tree is unprotected. Trees may be protected by TPOs not yet in our dataset, by conservation area designations, by planning conditions, or by other legislation.
- The presence of a TPO on our Site does not guarantee that the order is still in force. TPOs can be varied, revoked, or superseded.
- Map locations and boundary geometries are approximate and should not be used for precise surveying or legal purposes.
- You must always check with your local planning authority before carrying out any work on or near trees. Relying solely on information from this Site is done entirely at your own risk.
Limitation of liability
To the fullest extent permitted by law:
- The Site and its content are provided “as is” and “as available” without any warranty or representation of any kind, whether express or implied.
- We disclaim all warranties, including but not limited to warranties of accuracy, completeness, reliability, fitness for a particular purpose, and non-infringement.
- We shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the Site or its data, including but not limited to damages for loss of profits, fines, penalties, legal costs, or any other losses.
- We shall not be liable for any loss or damage arising from any action taken or not taken based on information on this Site, including but not limited to fines or penalties for unauthorised work on protected trees.
- Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by English law.
Acceptable use
You agree not to:
- Use automated tools, scrapers, or bots to systematically download or extract data from the Site
- Reproduce, redistribute, or commercially exploit the Site's data without our prior written consent
- Attempt to interfere with, disrupt, or overload the Site or its infrastructure
- Use the Site for any unlawful purpose or in violation of any applicable laws or regulations
- Misrepresent data obtained from the Site as being official planning authority records
We reserve the right to restrict or block access to the Site at our discretion, including by rate limiting, IP blocking, or requiring authentication.
API access
Access to our API is subject to separate terms agreed upon subscription. Unauthorised use of our API endpoints or systematic querying of the Site to extract data constitutes a breach of these terms.
Intellectual property
The design, layout, and original content of this Site are owned by T Corp Ltd and are protected by copyright. The underlying TPO data is sourced from public authorities and may be subject to their own licensing terms (typically the Open Government Licence).
Third-party services
The Site uses third-party services including Mapbox (mapping), Google AdSense (advertising), PostHog (analytics), and Formspree (forms). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the availability or content of third-party services.
Links to external sites
The Site may contain links to planning authority websites and other external resources. We are not responsible for the content, accuracy, or availability of external sites.
Changes to these terms
We may update these terms from time to time. Changes will be posted on this page with an updated date. Continued use of the Site after changes constitutes acceptance of the revised terms.
Governing law
These terms are governed by the laws of England and Wales. Any disputes arising from these terms or your use of the Site shall be subject to the exclusive jurisdiction of the courts of England and Wales.
